Update on the tax resolutions! Important message from Cointa Raviela, real estate lawyer in Puerto Vallarta, Riviera Nayarit!

Good news for real estate in Puerto Vallarta and the Riviera Nayarit

Hello again! I want to share really great news regarding the tax resolutions for real estate purchases. 
The Mexican government has clarified and amended the resolutions published on July 4th, 2014 as follows: 

Non Mexican Sellers are not required to obtain the CURP nor the RFC to sell a property unless they wish to attempt exempting capital gains (in that case, the requirements are the same: permanent residency, bills to prove the property is their primary household, RFC and the letter from SAT –formato 36- acknowledging the seller as a permanent resident for tax purposes). 
*Mexican Sellers will have to provide a copy of their CURP and RFC prior to closing. 
Purchasers will no longer have to attain Temporary Residency. Notaries will use a generic CURP. 
Purchasers will be issued an RFC with a Tourist Visa. The purchaser will have to attend a quick meeting at SAT with his/her Passport, Tourist Visa, and evidence of domicile from Mexico (any utility bill).

San Blas is also one of the best birding locations in Mexico, as well as a historical naval port dating to 1531. Nuevo Vallarta tourism has expanded, but retains its spectacular expanse of beach. Just north of Nuevo Vallarta is La Cruz de Huanacaxtle, with often empty beaches.

Bank trust remains for the border and coastal areas!

 Bancomer has been sending the following information to its customers...

Greetings, this is to inform you, that in relation to the reform initiative to the article 27, 2nd paragraph of the Mexican Constitution, in which was intended to remove the restriction for foreign nationals to purchase real estate near Beach and Border making disappear the trust contracts agreements.
Hereby advised that the proposal was rejected by the Mexican Senate Chamber, so the article of the law remains in effect and unchanged. 
Therefore we confirm that the trust agreement figure remains.
 Our recomendation is  to check the date of granted permit by the Foreign Affairs Secretary and in a case to be expired, please carry out the corresponding renewal, and check your trust fees statement to avoid debts and generation of fines and interest.

Le recomendamos  verificar la fecha de otorgamiento del Permiso que otorgó la S.R.E. y en caso de estar vencido  llevar  a cabo la renovación  correspondiente,   verificar su estado de cuenta de honorarios de fideicomiso para evitar adeudos  y  la generación de intereses.
